Financing a commodity purchase for a consumer falls under Section 2(c)(2)(D) of the Commodity Exchange Act, a statute written for the financing of gold and other physical commodities to stop dealers writing paper they could not deliver on. Bitcoin is a digital commodity, and the rule has not caught up. Under Chairman Michael Selig the CFTC has proposed its first framework for crypto asset markets, Regulation CAM, and we are awaiting final rules that recognise Bitcoin as a digital commodity and give this product a clear regulatory home.
